1 | INTRODUCTION & DEFINITIONS
1.1 Who We Are
These Terms and Conditions (“Agreement”) govern the relationship between you (“User”, “you”) and Fortuna Digital — a sole proprietorship operating the Fortuna Digital storefront.

1.3 Key Definitions

1.4 Binding Acceptance
By clicking “Buy and Waive My Right of Withdrawal”, creating an Account or using any Service you:

confirm that you have read and accepted this Agreement, the Privacy Policy and Cookie Policy; and
-
expressly request immediate digital delivery and acknowledge that your statutory withdrawal right ends once the key is displayed or automatically connected (§ 6).
If you do not agree, do not create an Account, purchase Products or use the Services.
1.5 Language
This Agreement is drafted in English. In case of conflict, the English text prevails over any translation.
2 | SCOPE OF SERVICES

2.2 Matters Outside Fortuna Digital’s Control
Third-party platforms (server downtime, DRM, policy changes); connectivity & hardware; physical shipping (digital-only service); beta or experimental modules (“as is”).
2.3 Service Interruptions
We may suspend Services for maintenance, security or force-majeure. Compensation is excluded except where mandatory consumer law provides otherwise.
2.4 Prohibited Technical Misuse
Reverse engineering, scraping, automated data collection, DDoS, unauthorised API calls and region-lock circumvention are strictly prohibited (§ 8).
2.5 Software Updates (EU 2019/770)
Where publishers supply updates to retailers, Fortuna Digital will provide them for a reasonable period to maintain conformity.
2.6 Micro-Transaction / Live-Service Disclaimer
In-game purchases are operated by publishers; Fortuna Digital is not liable for in-game charges or refunds.
3 | ACCOUNT REGISTRATION & USE
3.1 Eligibility & Age
One Account per natural person/household. Minimum age 16 (13–15 with parental consent). You must respect Product age ratings.
3.2 Accurate Information & KYC
Provide true, current information. Identity/payment verification may be requested for high-risk orders.
3.3 Credentials & Security
Keep password & 2-FA confidential, monitor account activity, report breaches promptly.
3.4 Permitted / Prohibited Uses

3.5 Profile Privacy
Default: Public. You may switch to Private in Settings › Privacy.
3.6 User-Requested Deletion
Account › Close Account. Irreversible; unused keys/store credit forfeited.
3.7 Fortuna Digital Suspension / Termination
Violations, fraud, multi-account abuse, legal obligations may trigger key revocation, credit freeze, data retention (§ 13).
4 | ORDERS, DELIVERY & FULFILMENT
4.1 Order Flow
Cart → Payment & Confirmation → Payment Authorisation → E-mail Acknowledgement → Instant Digital Delivery → Invoice PDF.
4.2 Contract Formation
A binding contract forms when the Product is digitally delivered; Fortuna Digital may decline an order until that moment.
4.3 Digital Delivery = Completion
Delivery is complete when a key is shown on-screen/emailed, a key-less connect flow succeeds, or store credit is granted. Backup is your responsibility.
4.4 Legal Conformity Guarantee (EU 2019/770)
For at least two years keys must work and match description. If defective (e.g., already used, wrong region, invalid) you are entitled to:

replacement; failing that

appropriate price reduction; or
-
contract termination & full refund.
4.5 Pre-orders
Payment captured immediately. Release dates may change; early access not guaranteed. Statutory withdrawal right remains until delivery.
4.6 Charge-backs
Unauthorised charge-backs ➜ key revocation, account suspension, debt collection.
4.7 Price, Tax & Currency
Prices include VAT/GST where applicable. Obvious pricing errors may be corrected prior to fulfilment.
5 | PRICING, CURRENCY & PAYMENT

Accepted methods: major credit/debit cards, PayPal, Apple Pay, Google Pay, selected local methods.

Strong Customer Authentication (3-D Secure) may be required; failure cancels the order.

Paying in another currency may incur FX/bank fees for you.
5.1 Refund Processing Time & Method
Approved refunds are credited to the original payment method where possible, otherwise to Fortuna Digital wallet credit, and are processed within 5–7 business days after approval.
5.2 Omnibus Price Transparency
During discounts we display the lowest price applied during the 30 days preceding the promotion.
6 | RETURNS & WITHDRAWAL POLICY
6.1 Statutory Withdrawal (EU/UK — 14 Days)
You may withdraw until digital delivery begins. By requesting immediate delivery you waive this right once the key is displayed or connected.
6.2 Fortuna Digital Voluntary Refund (7 Days)
Fortuna Digital may grant a goodwill refund or store credit when all conditions below are met:

Unused or Duplicate Key — key has not been viewed, downloaded or redeemed or duplicate purchase remains unused.

Timely Request — submitted within 7 days of purchase and at least 48 hours before official launch.

Proof of Issue — provide reasonable evidence (error message, duplicate order ID, screenshot).
6.3 Refund Exclusions
No refunds for: viewed/downloaded/redeemed keys; mystery bundles; DLC-only codes; purchases made or activated via VPN/proxy against regional rules; keys bought with gift cards already used; hardware or OS incompatibility.
6.4 How to Request
Account › Orders › “Request Refund”; include order number, key, evidence. Response within 72 hours.
6.5 Good-Will Exception
Once per account Fortuna Digital may deactivate an unused-but-viewed key and issue store credit.
6.6 Effects of Refund
Cancelled keys stop working; related in-game progress may be lost.
7 | INTELLECTUAL PROPERTY & LICENCE
Fortuna Digital and Fortuna Digital trademarks & site assets © Fortuna Digital. Publisher marks remain theirs. You receive a personal, non-transferable, revocable licence. Publisher EULA supersedes. No reverse engineering, scraping, derivative works, commercial exploitation or brand imitation. By submitting UGC you grant Fortuna Digital a perpetual, royalty-free, sublicensable licence and waive moral rights where law allows.
8 | PROHIBITED CONDUCT
Technical — bots, malware, scraping, VPN masking, region-lock circumvention, DDoS, unauthorised API calls
Financial — key resale, charge-back abuse, coupon stacking, money laundering
Content — illegal, hateful, infringing, personal-data leaks, spam
Illegal activities — gambling, child exploitation, sanctioned-party trade
Violations may result in content removal, key revocation, suspension, termination, legal action.
9 | GIFT CARDS, COUPONS & STORE CREDIT
Gift-card balance is deducted at payment. Validity: at least 24 months (5 years if no expiry printed). Lost/stolen codes are your responsibility. Misuse ➜ code revocation (§ 13).
10 | PRE-ORDERS, REGIONAL LOCKS & VPN USE
Release dates may change; early access not guaranteed. Region-lock labels (Global / Region Locked / Client Region Locked) appear on the Product page and at checkout. Purchasing or activating via VPN/proxy is forbidden and voids support/refund rights. If the price drops before launch, Fortuna Digital may (at its discretion) issue store-credit for the difference. No refunds < 48 h before launch.
11 | USER CONTENT & COMMUNITY RULES
You grant Fortuna Digital a perpetual, royalty-free licence to host, modify, display UGC; moral rights waived where lawful. Illegal, hateful, infringing, personal-data or spam content is forbidden. Fortuna Digital may edit, remove, mute or ban. DMCA/notice-and-takedown procedure applies.
12 | LIMITATION OF LIABILITY
Services are provided “as-is” except mandatory guarantees. Fortuna Digital is not liable for indirect, incidental, special losses (profit, data, reputation). Maximum aggregate liability = higher of (a) price of the affected Product or (b) total spend with Fortuna Digital in the last six months, except where mandatory consumer law provides otherwise. Third-party client outages lie outside Fortuna Digital’s control. You indemnify Fortuna Digital for damages arising from your breach of these Terms.
13 | ACCOUNT SUSPENSION, TERMINATION & APPEALS
Codes A-1–A-5: breach, fraud, multi-account, security threat, legal order.
Suspension — key/connect disabled, credit frozen.
Termination — assets forfeited, re-registration banned.
User deletion — irreversible; unused keys/credit forfeited.
Appeal via e-mail within 14 days; decision in 10 business days.
14 | CHANGES TO TERMS
Fortuna Digital may update Terms anytime. Notice via site banner/e-mail; changes take immediate effect unless stated. Continued use = acceptance. Prior versions archived for at least five years.
15 | GOVERNING LAW, DISPUTE RESOLUTION & FORCE MAJEURE
Dutch law governs; stronger local consumer rules preserved. Jurisdiction: Amsterdam District Court. ADR: Stichting Geschillencommissie (https://www.degeschillencommissie.nl). EU ODR platform: https://ec.europa.eu/odr. Parties seek amicable resolution (30 days) before formal action. Force-majeure relieves obligations; if > 30 days, undelivered orders may be cancelled.

17 | EXPORT CONTROL & SANCTIONS COMPLIANCE
You must comply with EU dual-use, U.S. EAR & OFAC sanctions. No sales or activations to embargoed territories or sanctioned users.
