1 | INTRODUCTION & DEFINITIONS

1.1 Who We Are

These Terms and Conditions ("Agreement") govern the relationship between you ("User", "you") and Fortuna Digital, a sole proprietorship registered in the Netherlands.

1.2 Our Services ("Services")

This Agreement covers your use of:
• Website – https://fortunadigital.net
• Applications – Any mobile, desktop or browser extension published by Fortuna
• Partner Platforms – Steam®, Ubisoft Connect™, Epic Games Launcher, etc.
• Key‑Delivery API & Support Systems
• Official social‑media channels & community forums

1.3 Key Definitions

Term Meaning
Account Your personal profile protected with e‑mail & password (optionally 2‑FA)
Product A digital video‑game activation key, DLC, in‑game currency, season pass, digital gift card or coupon
Order A completed payment transaction for one or more Products
Key / Activation Code Unique alphanumeric code that activates a Product on a third‑party platform
EULA End‑User Licence Agreement imposed by the publisher/developer
Region Lock Restriction allowing activation only in specified countries
UGC User‑generated content (text, images, video, links, etc.)
Service Components Website, apps, API, community, support & delivery infrastructure

1.4 Binding Acceptance

By clicking a button labelled “Buy and Waive My Right of Withdrawal”, creating an Account or otherwise using any Service, you:

  1. confirm that you have read and accepted this Agreement, our [Privacy Policy] and [Cookie Policy]; and

  2. expressly request immediate delivery of the digital content and acknowledge that your statutory right of withdrawal will be lost upon delivery (see § 6).

If you do not agree, do not create an Account, purchase Products or use the Services.

1.5 Language

This Agreement is drafted in English. Any translation is for convenience only; in the event of conflict, the English version shall prevail.


2 | SCOPE OF SERVICES

2.1 Components & Typical Risks

2.2 Matters Outside Fortuna’s Control

Fortuna is not responsible for:
• Third‑party platforms (server downtime, DRM, policy changes);
• Connectivity & hardware (ISP, device compatibility, firewalls);
• Physical shipping (we deliver only digital content);
• Beta / experimental modules (provided “as‑is”).

2.3 Service Interruptions

We may suspend Services temporarily or permanently for maintenance, security or force‑majeure reasons. Compensation is excluded except where mandatory consumer law provides otherwise.

2.4 Prohibited Technical Misuse

Reverse engineering, scraping, automated data collection, DDoS, unauthorised API calls and region‑lock circumvention are strictly prohibited (§ 8). Breach may lead to immediate suspension.

2.5 Software Updates (EU 2019/770)

Where a publisher supplies updates to retailers, Fortuna will provide those updates for a reasonable period so that the Product remains in conformity.

2.6 Micro‑Transactions / Live‑Service Disclaimer

In‑game purchases are operated by the publisher; Fortuna is not liable for in‑game charges or refunds.


3 | ACCOUNT REGISTRATION & USE

3.1 Eligibility & Age Limit

One Account per natural person and household. Minimum age 16 (13–15 with verifiable parental consent). You must respect the age rating of each Product.

3.2 Accurate Information & KYC

You must provide true, current information. Fortuna may request identity / payment verification for high‑risk orders.

3.3 Credentials & Security

You are responsible for safeguarding your password and 2‑FA, monitoring Account activity and promptly reporting unauthorised use.

3.4 Permitted & Prohibited Uses

Multiple Accounts to exploit promotions
VPN / proxy during purchase or activation

3.5 Profile Privacy

Default visibility is Public. You may switch to Private in Settings › Privacy.

3.6 User‑Requested Deletion

Account › Close Account. The process is irreversible; unused keys or store credit will be forfeited.

3.7 Fortuna’s Right to Suspend or Terminate

We may suspend or terminate Accounts for violation of these Terms, fraud, multiple Accounts, security threats or legal requirements (§ 13).


4 | ORDERS, DELIVERY & FULFILMENT

4.1 Order Flow

Cart › Payment & Confirmation › Payment Authorisation › E‑mail Acknowledgement › Instant Digital Delivery › Invoice PDF.

4.2 Contract Formation

A binding contract is formed when the Product is digitally delivered. Until that moment, Fortuna may decline an Order.

4.3 Digital Delivery = Completion

Delivery is deemed complete when:
• the activation key is displayed on screen and/or sent by e‑mail; or
• a key‑less “connect” flow (e.g. Steam Connect) finishes successfully; or
• store credit is credited to your Wallet.
You are responsible for backing up the key after delivery.

4.4 Legal Conformity Guarantee (EU 2019/770)

Products must be free of defects and functional for their intended purpose. If a key is defective (e.g. already redeemed, wrong region, invalid), you are entitled—free of charge and within a minimum period of two (2) years—to:

  1. replacement with a working key; failing that,

  2. an appropriate price reduction; or,

  3. termination and full refund.
    This guarantee is without prejudice to any additional publisher warranties.

4.5 Pre‑orders

Payment is taken immediately. Publishers may change release dates; early‑access is not guaranteed. Legal withdrawal right remains until digital delivery (§ 6).

4.6 Charge‑backs

Unauthorised charge‑backs may lead to key revocation, Account suspension and the debt being assigned to a collection agency.

4.7 Price, Tax & Currency

Displayed prices include VAT or GST where applicable. Obvious pricing errors may be corrected prior to fulfilment.


5 | PRICING, CURRENCY & PAYMENT

Accepted methods: major credit/debit cards, PayPal, Apple Pay, Google Pay, selected local methods, and crypto‑payments (non‑refundable). Strong Customer Authentication (3‑D Secure) may be required; failure results in order cancellation.

5.1 Foreign Currency & Fees

If you pay in a currency different from your card’s billing currency, foreign‑exchange and bank fees are your responsibility.

5.2 Refund Processing

Approved refunds are credited to the original payment method where possible; otherwise to Fortuna store credit.

5.3 Omnibus Price Transparency (EU 2019/2161)

Where a discount is shown, we also display the lowest price applied during the 30 days preceding the promotion.


6 | RETURNS & WITHDRAWAL POLICY

6.1 Statutory Withdrawal (EU⁄UK – 14 Days)

You may withdraw from a purchase until digital delivery starts. By explicitly requesting immediate delivery (§ 1.4), you waive this right upon delivery.

6.2 Fortuna Voluntary Refund (7 Days)

First‑time refund requests for keys that have not been viewed, downloaded or redeemed, and are ≥ 48 hours prior to the official launch, may be approved at Fortuna’s discretion.

6.3 Refund Exclusions

Refunds are not available for: viewed/redeemed keys, crypto payments, mystery bundles, DLC codes, VPN purchases, or used gift cards.

6.4 How to Request a Refund

Account › Orders › “Request Refund”. We respond within 72 hours.

6.5 Good‑Will Exception

Once per Account we may, at our sole discretion, cancel an unused-but‑viewed key and issue store credit. The key will be deactivated.

6.6 Effects of Refund

Cancelled keys will not function. Game progress linked to the key may be lost.


7 | INTELLECTUAL PROPERTY & LICENCE

8 | PROHIBITED CONDUCT

Technical misuse (bots, malware, VPN masking), financial fraud (resale, charge‑back abuse, coupon stacking), illegal content (hate, copyright infringement, doxxing) and unlawful activities (money laundering, gambling, child exploitation) are strictly prohibited. Breach may result in content removal, key revocation, Account suspension or legal action.


9 | GIFT CARDS, COUPONS & STORE CREDIT

Gift‑card balance is deducted at the moment of payment. Gift Cards are valid for a minimum of 24 months from purchase unless a longer period is printed; Coupons are valid for the promotional period stated. Lost or stolen codes are your responsibility. Misuse (multi‑account, stolen payment) results in code revocation (§ 13).


10 | PRE‑ORDERS, REGIONAL LOCKS & VPN USE

Release dates may change; early‑access is not guaranteed. Region‑lock labels (Global / Region Locked / Client Region Locked) are shown on the Product page and at checkout. Purchasing or activating via VPN/proxy is strictly prohibited and voids support and refund rights.

If the price drops before launch, Fortuna may—at its discretion—issue store‑credit for the difference. Refund requests within 48 hours of launch are not accepted.


11 | USER CONTENT & COMMUNITY RULES

You grant Fortuna a perpetual, royalty‑free licence to host and display your UGC, waiving moral rights to the extent permitted by law. Illegal, hateful, infringing, personal‑data, or spam content is forbidden. We may edit, remove, mute or ban at our discretion. Copyright notices follow the DMCA procedure.


12 | LIMITATION OF LIABILITY

The Services are provided “as‑is” except for mandatory statutory warranties. Fortuna shall not be liable for indirect, incidental, special losses (including loss of profit, data or reputation). Maximum aggregate liability shall not exceed the higher of (a) the price you paid for the Product in question, or (b) your total spend with Fortuna in the preceding six (6) months, except where mandatory consumer law provides otherwise. Third‑party client outages are outside Fortuna’s control.

You agree to indemnify Fortuna for damages arising from your breach of this Agreement.


13 | ACCOUNT SUSPENSION, TERMINATION & APPEALS

Codes A‑1 to A‑5: breach, fraud, multiple Accounts, security threats, legal order.
Suspension – key / connect disabled, credit frozen.
Termination – all assets forfeited, re‑registration banned.
User deletion – irreversible; unused keys / credit forfeited.
Appeals: e‑mail within 14 days; final decision in 10 business days.


14 | CHANGES TO TERMS

We may update these Terms at any time. Notice is provided via site banner and/or e‑mail. Changes take immediate effect unless stated otherwise. Continued use of the Services constitutes acceptance. Previous versions are archived for at least five (5) years.


15 | GOVERNING LAW, DISPUTE RESOLUTION & FORCE MAJEURE

This Agreement is governed by Dutch law, without prejudice to stronger local consumer protections.
Jurisdiction: Amsterdam District Court.
Alternative Dispute Resolution (ADR): Stichting Geschillencommissie (https://www.degeschillencommissie.nl)
EU ODR platform: https://ec.europa.eu/odr.
Parties shall attempt amicable resolution within 30 days before formal proceedings.

Force‑majeure events relieve the affected party of obligations for their duration. If such event exceeds 30 days, undelivered Orders may be cancelled.

Alternative accessible formats are available on request. Historic versions are kept for five (5) years and provided upon request. Electronic notices sent to your Account e‑mail are deemed received immediately.


17 | EXPORT CONTROL & SANCTIONS COMPLIANCE

You agree to comply with all applicable export‑control and sanctions regulations, including EU Dual‑Use Regulation, U.S. EAR and OFAC rules. You may not purchase or activate Products in embargoed territories or for proscribed end‑users.
